FTA APP PRIVACY POLICY / Terms and Conditions

Effective Date: June 2025 

 These Privacy Policy describes how the International Potato Center (“CIP”, “we”, “our”, or “us”), as the data controller, collects, uses, stores, and discloses your personal data when you use the Smart FTA mobile application (hereinafter referred to as “Smart FTA”). This policy also explains your rights regarding your personal data and how you can exercise those rights. 

Please read our Privacy Policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information at Smart FTA. By continuing to use our Smart FTA, you acknowledge that you have had the chance to review and consider this Privacy Policy, and you acknowledge that you agree to it. This means that you also consent to the use of your information and the method of disclosure as described in this Privacy Policy. If you do not understand the Privacy Policy or do not agree to it, then you agree to immediately cease your use of Smart FTA. 

  1. Definitions 

These are key terms used in this Policy: 

  1. Applicable mobile application: This Privacy Policy will refer to and be applicable to Smart FTA mobile application, which shall hereinafter be referred to as “Smart FTA”. 
  1. Effective Date: Means the date this Privacy Policy comes into force and effect. 
  1. Parties: The parties to this privacy policy are the following data controller: International Potato Center (“CIP” or “Data Controller”) and you, as the user of Smart FTA. Hereinafter, the parties will individually be referred to as “Party” and collectively as “Parties.” 
  1. Data Controller: Data Controller is the publisher, owner, and operator of Smart FTA and is the Party responsible for the collection of information described herein. Data Controller shall be referred to either by Data Controller’s name or “Data Controller,” as listed above. 
  1. Data Subject: Should you agree to this Privacy Policy and continue your use of Smart FTA, you will be referred to herein as either you, the user, or if any second-person pronouns are required and applicable, such pronouns as ‘your”, “yours”, etc. 
  1. Personally Identifiable Information (PII) or Personal Data: means personal data and information that we obtain from you in connection with your use of Smart FTA that can identify you in any manner.

  1. Jurisdiction and Data Transfers 

Personal data collected via Smart FTA may be processed in various countries where the International Potato Center (CIP) or its authorized service providers operate. This may include countries outside of your own and outside of regions with equivalent data protection laws, such as the European Economic Area (EEA). 

When transferring personal data internationally, we implement appropriate legal and technical safeguards to ensure an adequate level of data protection, in accordance with applicable laws and regulations, including the General Data Protection Regulation (GDPR) where applicable. These safeguards may include standard contractual clauses, data processing agreements, and other lawful mechanisms approved for international data transfers. 

By using Smart FTA, you acknowledge and consent to the international transfer, processing, and storage of your personal data as described above. 

  1. Policy Updates 

CIP hereby reserves the right to modify, revise or otherwise amend this Privacy Policy as it may deem necessary at any time, and will be effective as soon as posted. Your continued use of the application constitutes acceptance of any amendments. 

  1. Personal Data We Collect 
  1. Registered Users: You, as a user of Smart FTA, shall be asked to register to use Smart FTA in a legal manner. During the process of your registration, we will collect some of the following Personal Data from you through your voluntary disclosure:  
  • Name 
  • Username 
  • Email address 
  • Business name 
  • Phone 
  • Contact address 
  • Shipping Address 

This Personal Data may be asked for in relation to: 

  1. Requesting and shipping FTA cards for research purposes. 
  1. Communication with our representatives for the purpose of fulfilling your FTA card request. 
  1. Receiving general emails from us. 

By undergoing the registration process, you consent to us collecting your Personal Data, including the Personal Data described in this clause, as well as storing, using or disclosing your Personal Data in accordance with this Privacy Policy. 

  1. Non-Identifiable Information 

CIP may access, record, and analyze data collected about your interaction with Smart FTA. This may include your: 

  • IP address 
  • the URL/domain name of any referring website 
  • the time and date of your visit to Smart FTA and other user content visited, among other 

This information cannot be traced back to a particular individual and is never connected to the personal contact information you provide to us. 

  1. Use of Cookies 

CIP may record and analyze non-indirectly identifiable information by using cookies. Cookies are small strings of text used to store some information that may concern the user, his or her preferences or the device they are using to access the internet (such as a computer, tablet, or mobile phone). Cookies are mainly used to adapt the operation of the site to your expectations, offering a more personalized browsing experience and memorizing the choices you made previously. 

Third-party analytical cookies may also be installed. They are sent from the domains of the aforementioned third parties external to the site. Third-party analytical cookies are used to detect information on user behavior on Smart FTA, to monitor performance and improve the usability of the system.

  1. Third Parties 

We may utilize third-party service providers (“Third-Party Service Providers”), from time to time or all the time, to help us with Smart FTA, and to help serve you. We may use Third-Party Service Providers to assist with information storage (such as cloud storage). 

We may provide some of your Personal Data to Third-Party Service Providers to help us track usage data, such as referral websites, dates and times of page requests, process shipping, etc. We use this information to understand patterns of usage of, and to improve, Smart FTA. 

We use Third-Party Service Providers to host Smart FTA. In this instance, the Third-Party Service Provider will have access to your Personal Data. 

We only share your Personal Data with a Third-Party Service Provider if that provider agrees to our privacy standards as set out in this Privacy Policy. 

Your Personal Data will not be sold or otherwise transferred to other third parties without your approval. Notwithstanding the other provisions of this Privacy Policy, we may provide your Personal Data to a third party to protect the rights, property or safety, of us, our customers or third parties, or as otherwise required by law. 

We will not knowingly share your Personal Data with any third parties other than in accordance with this Privacy Policy. 

If your Personal Data might be provided to a third party in a manner other than as explained in this Privacy Policy, you will be notified. You also can request that we not share that information. 

In general, you may request that we do not share your Personal Data with third parties. Please contact us via email if you need help. Please be advised that you may lose access to certain services that we rely on third-party providers for. 

  1. Data Security and Storage 

We use secure digital systems to store your Personal Data when appropriate. We ensure that your Personal Data is protected against unauthorized access, disclosure, or destruction. Please note, however, that no system involving the transmission of information via the internet, or the electronic storage of data, is completely secure. However, we take the protection and storage of your Personal Data very seriously. We take all reasonable steps to protect your Personal Data. 

The systems that we use to store your information include but are not limited to: Hostinger databases, and Android private file system. 

Personal Data is stored throughout your relationship with us. We delete your Personal Data upon request for cancelation of your account or other general request for the deletion of data. In the event of a breach of your Personal Data, you will be notified in a reasonable time frame, but in no event later than two weeks, and we will follow all applicable laws regarding such a breach. 

  1. Purposes of Processing of Personal Data 

We primarily use your Personal Data to help us provide you with the services and/or information you may have requested, such as processing your requests for FTA cards. 

Information that does not identify you personally, but that may assist in providing us with broad overviews of our users’ base, will be used for improving the site. Such information may include, but is not limited to, interests based on your cookies. Personal Data that may be considered identifying may be used for the following: Improving your personal user experience, communicating with you about your user account with us and advising you about updates to Smart FTA or related items. 

  1. Disclosure of Personal Data 

Although our policy is to maintain the privacy of your Personal Data as described herein, we may disclose your Personal Data if we believe that it is reasonable to do so in certain cases, in our sole and exclusive discretion. Such cases may include, but are not limited to: 

  1. To satisfy any local, state, or federal laws or regulations 
  1. To respond to requests, such discovery, criminal, civil, or administrative process, subpoenas, court orders, or writs from law enforcement or other governmental or legal bodies 
  1. To bring legal action against a user who has violated the law or violated the Terms of Use of Smart FTA. 
  1. As may be necessary for the operation of Smart FTA. 
  1. To generally cooperate with any lawful investigation about our users. 
  1. If we suspect any fraudulent activity on Smart FTA or if we have noticed any activity which may violate our terms or other applicable rules. 
  1. Modifying, deleting, and accessing your information 

If you wish to modify or delete any information, we may have about you, or you wish to simply access any information we have about you, you may do so from your account settings page. 

  1. User Rights Over Personal Data 

You have many rights in relation to your Personal Data. Specifically, your rights are as follows: 

  1. the right to be informed about the processing of your Personal Data 
  1. the right to have access to your Personal Data 
  1. the right to update and/or correct your Personal Data 
  1. the right to portability of your Personal Data 
  1. the right to oppose or limit the processing of your Personal Data 
  1. the right to request that we stop processing and delete your Personal Data 
  1. the right to block any Personal Data processing in violation of any applicable law 
  1. the right to submit a complaint with the applicable data protection authority in the corresponding jurisdiction.

Smart FTA is owned and managed by the International Potato Center (CIP). 

These Terms and Conditions (“Terms”) govern your access to and use of the Smart FTA website and mobile apps (“Smart FTA”). Please read these Terms carefully and contact us if you have any questions. By accessing or using Smart FTA, you are agreeing to be bound by these Terms and our Privacy Policy. 

CIP reserves the right to modify these Terms at its discretion at any time, such modifications being effective when posted. 

  1. Access and use to Smart FTA 

To access and use Smart FTA, you must create a Smart FTA account. When you do so, you will choose a user identifier, which may be your email address or another term, as well as a password. You may also provide personal information, including, but not limited to, your name and country. You are responsible for ensuring the accuracy of this information. This identifying information will enable you to use Smart FTA. 

Any use or access by anyone under the age of 13 is not allowed. You may only use Smart FTA if you are over the age at which you can provide consent to data processing under the laws of your country. CIP assumes no responsibility or liability for any misrepresentation of your age. 

Using Smart FTA may include downloading software to your computer, phone, tablet, or other device. You agree that we may automatically update that software, and these Terms will apply to any updates. 

Providing false or inaccurate information or using Smart FTA to further fraud or unlawful activity is grounds for immediate termination or suspension of your right to access or use Smart FTA. 

  1. License to Smart FTA Content 

CIP may provide you with certain information as a result of your use of Smart FTA. Such information may include, but is not limited to, documentation, data, images, text or information developed or licensed by CIP, except by User’s Content, and other content which may assist in your use of Smart FTA (“Content”). 

Access and use to Smart FTA is provided in accordance with the CGIAR Principles on the Management of Intellectual Assets (https://www.cgiar.org/resources/cgiar-intellectual-asset-management/) and the CGIAR Open Access Policy (https://www.cgiar.org/resources/open-access/).  

For this purpose, unless otherwise and explicitly stated, Smart FTA and its Content are made available by the Creative Commons Attribution Non-Commercial License 4.0 International (CC-BY-NC 4.0). Thus, you may download, copy, reproduce, republish, modify, build upon, post, broadcast, transmit, distribute, make available to the public, or otherwise use Smart FTA Content, provided that (i) you give appropriate credit to the work and any identified source as provided in the corresponding citation, and indicate if changes were made. You may do so in any reasonable manner, but not in any way that suggests the licensor endorses you or your use. (ii) your use is for non-commercial, research, educational, or personal purposes, and (iii) you, in turn, license such Materials under the same conditions. Should you wish to deviate from these conditions, please contact CIP to obtain prior authorization. 

You agree to not use, reproduce or distribute Smart FTA or CIP trademarks without prior written authorization. 

  1. User content 

Smart FTA allows you to create, post and update content, including data, photos, comments, links, and other information. Anything that you post or otherwise make available on Smart FTA is referred to as “User Content.” You retain all rights in, and are solely responsible for, the User Content you post to Smart FTA. 

By this Terms you agree to grant CIP and, Smart FTA and its users a royalty free, non-exclusive, sub-licensable, transferable, perpetual, worldwide license to use, save, store, display, modify, reproduce, perform, publish, disseminate and make derivative work your User Content on Smart FTA solely for the purposes of operating, developing, providing, and using Smart FTA 

 

CIP may, at its sole discretion, remove or modify your User Content if it establishes that it violates these Terms or any other policies. Acceptance of User Content does not constitute endorsement or sponsorship of the User Content by Smart FTA or CIP. 

Following termination or deactivation of your account, or if you remove any User Content from Smart FTA, we may keep your User Content for a reasonable period for backup, archival, or audit purposes. Smart FTA and its users may retain and continue to use, store, display, reproduce, modify, create derivative works, perform, and distribute any of your User Content that other users have stored or shared on Smart FTA. 

  1. Third Party Content 

Use and access to third party content is governed by the terms of use applicable and contained in such third-party websites or apps from which such third-party content originates. CIP is not responsible and has no control over third party content, thus CIP makes no warranties or representations about the content, information, products, or services offered by third parties. Unless otherwise expressly stated, no sponsorship or endorsement by CIP is therefore implied. If you access any third-party website, service, or content from Smart FTA, you do so at your own risk. 

  1. Prohibited Use 

You agree not to use Smart FTA or its Content for any unlawful, illegal, fraudulent or harmful purpose or any activity that would violate Smart FTA, CIP and third-party rights, including but not limited to intellectual property rights. You further agree not to use Smart FTA or its Content: 

  1. To harass, abuse, or threaten others or otherwise violate any person’s legal rights. 
  1. To violate any intellectual property rights of Smart FTA, CIP or any third party. 
  1. To upload or otherwise disseminate any computer viruses or other software that may damage the property of another. 
  1. To perpetrate any fraud. 
  1. To engage in or create any unlawful gambling, sweepstakes, or pyramid scheme. 
  1. To publish or distribute any obscene or defamatory material. 
  1. To publish or distribute any material that incites violence, hate, or discrimination towards any group. 
  1. To unlawfully gather information about others. 

 

  1. Indemnification 

You agree to indemnify and hold CIP, its employees, officers, trustees and affiliates (if applicable) harmless from and against any claims, suits, proceeding, disputes, demands, losses, damages, costs and expenses, including without limitation, legal fees, resulting or any way related to your access or use of Smart FTA, its Content, your User Content or violation of these Terms; and to fully cooperate in CIP’s defense against any such claims. 

  1. Termination 

CIP may terminate or suspend your right to access or use Smart FTA at any time for any reason, with or without cause. CIP specifically reserves the right to terminate or suspend your access immediately and without notice if you violate any of the terms outlined herein, including, but not limited to, violating the intellectual property rights of CIP, Smart FTA or a third party, failing to comply with applicable laws or other legal obligations, and/or publishing or distributing illegal material. If you have registered for an account with us, you may also terminate your access to Smart FTA at any time by contacting us and requesting termination. Any provisions that would be expected to survive termination by their nature shall remain in full force and effect. 

  1. Disclaimer/Limitation of liability 

Smart FTA and its Content is provided by CIP on an “as is” basis. CIP does not warrant or make any representation that any of such Content is accurate, complete or current. CIP makes no warranties, either express or implied, as to the reliability, merchantability, and fitness for a particular purpose of any of the Content, as well as to the non-infringement of intellectual property rights or any other violation of rights. In no event shall CIP be liable for any loss or damages of any nature, including special, indirect, punitive or consequential damages, arising in connection with the access, use, or reliance on Smart FTA and its Content. CIP may make changes to any Content on Smart FTA at any time without notice 

CIP assumes no responsibility or liability for any User Content that you or any other person posts or sends using Smart FTA. You hereby understand and agree that you may be exposed to User Content that’s inaccurate, objectionable, or otherwise unsuited to your purpose. 

 

  1. Law 

These Terms are governed by and construed in accordance with recognized principles of international law, to the exclusion of any single national system of law. You and CIP agree to make every effort to settle amicably any dispute, controversy or claim that may arise out of or relating to Smart FTA.  Should an amicable resolution not be reachable within sixty (60) days of such dispute, the dispute shall be finally settled under the Rules of Arbitration of United Nations Commission on International Chamber of Commerce Trade Law (UNCITRAL) by one or more arbitrators appointed in accordance with the said Rules. The place of arbitration will be Lima, Peru.
